TERMS OF USE

Welcome to SpoilRoyale.com ("Spoil Royale," "Spoil," "we," "our," or "us"). By accessing or using our website or game (the "Service"), you agree to these Terms of Use and our Community Guidelines, which are incorporated into these Terms by reference.

If you do not agree, do not use the Service.

  1. Eligibility
    Spoil Royale is intended for users 18 years of age or older.
    By creating an account or using the Service, you represent that you are at least 18 years old.
    During account creation, you will be asked to provide your date of birth. Providing false information about your age is a violation of these Terms.
    We do not knowingly permit users under 18 to create accounts. If we become aware that a user is under 18, we will terminate the account and delete associated data.
  2. Account Registration
    You may create an account using third-party authentication providers such as:
    • Google
    • Apple
    We do not store passwords. Authentication is handled securely by those providers.
    You agree to:
    • Provide accurate information, including your date of birth
    • Maintain access to your authentication provider
    • Be responsible for activity associated with your account
    • Not share your account with others or allow others to access it
  3. Usernames & Public Information
    You may select a display username. Usernames:
    • Are publicly visible to other players
    • May appear in leaderboards or gameplay tables
    You may not:
    • Use offensive, obscene, hateful, or harassing language
    • Impersonate others
    • Use misleading or infringing names
    • Include personal information of yourself or others
    We reserve the right to:
    • Require username changes
    • Suspend or terminate accounts for violations
  4. Acceptable Use
    You agree not to:
    • Harass, threaten, bully, or discriminate against other players
    • Exploit bugs or cheats
    • Reverse engineer the game
    • Attempt unauthorized access to the Service or other accounts
    • Disrupt servers or infrastructure
    • Use the Service for any unlawful purpose
    • Violate our Community Guidelines
    Your use of the Service is also governed by our Community Guidelines, which are incorporated into these Terms by reference. Violations of the Community Guidelines are violations of these Terms.
  5. Voice and Video Communications
    The Service may offer live voice and video chat features to enhance the social gameplay experience. By using these features, you acknowledge and agree to the following:
    • A. Real-Time, User-Generated Content.
      Voice and video chat features transmit user-generated content in real time. Spoil does not pre-screen, monitor, record, or store voice or video streams. Voice and video are transmitted live through a third-party infrastructure provider (LiveKit) and are not retained by Spoil.
    • B. No Endorsement.
      Spoil does not endorse and is not responsible for any statements, opinions, conduct, or content of users transmitted through voice or video features. Opinions expressed by users are those of the users alone.
    • C. Other Players Can See and Hear You.
      When you enable voice or video, other players in your lobby will be able to see and hear you in real time. Do not share personal information you do not want others to know.
    • D. No Recording by Users.
      You agree not to record, capture, or distribute voice or video streams of other users without their express consent. This includes screen recording, audio recording, or any other method of capture. Violations may also violate state and federal wiretapping and recording laws.
    • E. Assumption of Risk.
      You acknowledge that live communication with other users involves inherent risks, including exposure to content or conduct you may find objectionable. Use of voice and video features is at your own risk.
    • F. Conduct Standards.
      All voice and video communications must comply with our Community Guidelines. Prohibited conduct includes but is not limited to:
      • Harassment, bullying, or threats
      • Hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
      • Sexual content, nudity, or sexually suggestive behavior
      • Content involving or directed at minors in a sexual manner (strictly prohibited)
      • Threats of violence
      • Sharing personal information of others without consent
      • Recording or capturing other users without consent
      • Impersonation
      • Illegal activity
    • G. If You Feel Unsafe.
      If you experience harassment, bullying, discrimination, threats, or any conduct that makes you uncomfortable:
      1. Use the in-game report button to flag the user.
      2. Leave the lobby. Do not remain in a game where you feel unsafe or are being abused.
      3. Email play@spoilroyale.com if you would like to follow up directly.
      4. If you believe you or someone else is in immediate danger, contact local emergency services.
  6. Reporting and Enforcement
    • A. How to Report.
      You may report violations of these Terms or our Community Guidelines by:
      • Using the in-game report button
      • Emailing play@spoilroyale.com
    • B. Review Process.
      Reports are reviewed by Spoil staff. Reporter identities are kept confidential from the reported user.
    • C. Enforcement Tiers.
      Spoil enforces the Terms and Community Guidelines as follows:
      • First report (non-severe violations): The reported user receives notice and a warning.
      • Second report (non-severe violations): The reported user's account is permanently removed.
      • Severe violations: A single confirmed report of a severe violation will result in immediate, permanent account termination. Severe violations include but are not limited to: content sexually exploiting or endangering minors, credible threats of violence, hate speech, sexual harassment, sharing of intimate imagery without consent, doxxing, and illegal activity.
    • D. Spoil's Discretion.
      Spoil reserves the right to take any enforcement action it deems appropriate, including warnings, temporary suspensions, permanent account termination, and reporting to law enforcement, regardless of strike count, where Spoil determines such action is warranted.
    • E. Appeals.
      A user whose account has been terminated may appeal by emailing play@spoilroyale.com within 30 days of termination. Spoil will review appeals and respond within a reasonable period. Spoil's decision on appeal is final.
    • F. Cooperation with Law Enforcement.
      Spoil may cooperate with law enforcement investigations and disclose user information when required by law, subpoena, or court order, or when Spoil reasonably believes disclosure is necessary to prevent harm.
    • G. Mandatory Reporting.
      Spoil is required by federal law (18 U.S.C. § 2258A) to report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC). Spoil will report and cooperate fully with NCMEC and law enforcement on any such matter.
  7. Intellectual Property & Patent Notice
    All game mechanics, branding, rules, and content are owned by Spoil Royale and protected by intellectual property law.
    The core mechanics are patent pending with the United States Patent and Trademark Office under U.S. Patent Application No. 63/811,839.
    You may not copy, reproduce, distribute, or commercialize any part of the game without written permission.
  8. DMCA / Copyright Policy
    Spoil respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

    • B. Notice Requirements.
      A valid DMCA notice must include:
      1. A physical or electronic signature of the copyright owner or authorized agent
      2. Identification of the copyrighted work claimed to be infringed
      3. Identification of the material claimed to be infringing and its location on the Service
      4. Contact information of the complaining party
      5. A statement of good faith belief that the use is not authorized
      6. A statement, under penalty of perjury, that the information is accurate and the complaining party is authorized to act
    • C. Counter-Notices.
      If you believe material was removed in error, you may submit a counter-notice to our designated agent.
    • D. Repeat Infringers.
      Spoil will terminate the accounts of users who are determined to be repeat infringers.
  9. Virtual Goods & Purchases (When Enabled)
    If we offer in-game purchases:
    • Digital items are licensed, not owned
    • They have no real-world monetary value
    • They are non-transferable
    • Refunds are provided only as required by law
    Payments are processed by third-party payment processors. We do not store credit card numbers.

    No Gambling; No Real-Money Value. Spoil Royale and all game modes are provided solely for entertainment purposes. The game is not a gambling platform. No real-money wagers are placed, and no digital items, points, chips, or virtual assets obtained through gameplay may be redeemed for real-world currency, prizes, or monetary value. All in-game items are virtual and have no cash value.
  10. Termination
    We may suspend or terminate your account at our discretion for violations of these Terms or our Community Guidelines, or for any other reason we deem appropriate, with or without notice.
    You may delete your account at any time through your account settings or by contacting us.
    Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution) shall survive.
  11. Indemnification
    You agree to indemnify, defend, and hold harmless Spoil Royale, its members, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
    • Your use of the Service
    • Your violation of these Terms or our Community Guidelines
    • Your violation of any rights of any third party, including other users
    • Any content you transmit through the Service, including through voice or video features
    • Your violation of any law
  12. Disclaimer of Warranties
    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

    SPOIL DOES NOT WARRANT THE CONDUCT OF ANY USER OR THE CONTENT TRANSMITTED THROUGH VOICE OR VIDEO FEATURES.
  13. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPOIL ROYALE, ITS MEMBERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING ANY CONDUCT OR CONTENT OF OTHER USERS TRANSMITTED THROUGH VOICE OR VIDEO FEATURES.

    IN NO EVENT SHALL SPOIL'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SPOIL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

    SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.
  14. Dispute Resolution
    • A. Informal Resolution.
      Before filing any formal claim, you agree to first contact us at play@spoilroyale.com and attempt to resolve the dispute informally for at least 30 days.
    • B. Binding Arbitration.
      Any dispute arising from or related to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration administered by [American Arbitration Association / JAMS], rather than in court, except that you may bring claims in small claims court if eligible.
    • C. Class Action Waiver.
      You and Spoil agree that any dispute will be brought in an individual capacity only, and not as part of any class, collective, or representative action.
    • D. Governing Law.
      These Terms are governed by the laws of the State of North Carolina, without regard to conflict of laws principles.
    • E. Venue.
      For any claim not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina.
  15. Changes to Terms
    We may update these Terms by posting a revised version. Material changes will be communicated through the Service or by email when reasonably possible. Continued use of the Service after changes constitutes acceptance.
